These Terms and Conditions govern the sale of products and the provision of saddle fitting and related services by Western Tack Trader. By booking a saddle fitting appointment, purchasing a product or using this website, you agree to these Terms and Conditions. Please read them carefully before using our services.

1. About us

Throughout these Terms and Conditions, "Western Tack Trader", "WTT", "we", "our" and "us" refer to Jennifer Sheerin trading as Western Tack Trader.

 

2. Our products and services

Western Tack Trader supplies a range of new and used Western saddles together with saddle pads, tack, accessories, clothing and other equestrian products. We also provide professional saddle fitting services in-person and remotely throughout the United Kingdom and remote saddle fitting consultations for customers worldwide. All products are subject to availability. Prices and product availability may change without notice.

 

3. Booking a saddle fitting

Customers wishing to arrange a saddle fitting should contact Western Tack Trader by telephone or email. Before an appointment can be arranged, customers will normally be asked to provide sufficient information to allow suitable saddles to be selected. This may include:

  • photographs of the horse

  • photographs of the rider where appropriate

  • wither tracings

  • information about the horse

  • information about the rider

  • intended riding discipline

  • budget

  • any previous saddle history

  • any other information considered relevant.

 

Western Tack Trader will provide guidance explaining how wither tracings and photographs should be taken. Following assessment of the information provided, suitable saddles will be discussed with the customer before a fitting appointment is arranged. All fitting fees, mileage charges and any other costs will be confirmed before the appointment is booked.

 

4. Saddle fitting appointments

During the appointment WTT will assess the horse and discuss the customer's requirements. Suitable saddles will be fitted and adjusted where appropriate. Customers may ride in any saddle that WTT considers suitable for assessment. WTT will provide recommendations based on their professional knowledge, experience and the information available on the day. The final purchasing decision always remains the customer's.

 

5. Mileage and fitting fees

Mileage is charged at £1.50 per mile, calculated one way only. Mileage charges are agreed with the customer before the appointment.

Any applicable fitting fee will be confirmed in advance. If a saddle is purchased during the appointment, the fitting fee will be deducted from the cost of the saddle. Where no saddle is purchased, the agreed fitting fee remains payable. Unless otherwise agreed, payment for mileage and fitting fee are due prior to the appointment, and payment for any items purchased is due immediately following the appointment.

 

6. Cancellation policy

Appointments may be cancelled or rearranged without charge provided at least 48 hours' notice is given. If less than 48 hours' notice is provided, Western Tack Trader reserves the right to charge:

  • the full agreed fitting fee; and

  • the full agreed mileage charge.

 

This applies regardless of the reason for cancellation unless WTT agrees otherwise.

Cancellation of group fitting appointments

Where a saddle fitting forms part of a group fitting event, the mileage charge is calculated based on the number of customers participating and the total travel costs for that event. This fee is agreed with all participants at the time of booking.

For group fittings, customers share the cost of WTT's travel. The agreed mileage fee is calculated based on the number of customers booked onto the trip. If a customer cancels within seven (7) days of the scheduled group fitting, the mileage and fitting fee is non-refundable. This is because WTT has already committed to the journey and the travel costs have been agreed and shared between the confirmed participants.

Any additional fitting fees will be dealt with in accordance with the cancellation policy set out in these Terms and Conditions.

 

7. Missed appointments

If WTT arrives for a booked appointment and:

  • the customer is not present;

  • the horse is unavailable;

  • the horse is not ready for the appointment; or

  • the appointment cannot proceed for reasons within the customer's control, the agreed mileage and fitting fees remain payable.

 

Any future appointment will be entirely at WTT's discretion.

 

8. Horse welfare and safety

The welfare of the horse is always the highest priority. Western Tack Trader reserves the right to refuse to begin or continue a saddle fitting where they reasonably believe that continuing would compromise the welfare of the horse or the safety of any person present. 

Examples include, but are not limited to:

  • dangerous or aggressive behaviour

  • inadequate handling

  • unsuitable facilities

  • unsafe footing

  • poor weather conditions

  • illness or injury

  • obvious lameness

  • suspected back pain

  • unsuitable tack

  • equipment failures.

 

Where WTT believes that veterinary assessment or another professional opinion is required before fitting can continue, they may terminate the appointment. This decision is entirely at their professional discretion.

 

9. Rider safety

Customers ride entirely at their own risk. Western Tack Trader strongly recommends that all riders wear appropriate riding safety equipment, including a correctly fitted riding helmet and suitable footwear. Where a rider chooses not to wear recommended safety equipment, this is entirely their own decision. Western Tack Trader accepts no responsibility for injuries arising from that decision.

 

10. Saddle recommendations

Every saddle recommendation is based upon:

  • the horse's condition on the day

  • the rider's requirements

  • information supplied by the customer

  • WTT's professional assessment.

 

No saddle can be guaranteed to remain a perfect fit indefinitely. Horses naturally change shape due to factors including:

  • work

  • fitness

  • muscle development

  • age

  • weight changes

  • health

  • nutrition

  • management

  • seasonal variation.

 

These changes may affect saddle fit over time.

During each fitting WTT will explain the factors most likely to influence the fit of the selected saddle for that individual horse and provide guidance on how long the saddle is expected to remain suitable under normal circumstances. Regular reassessment of saddle fit is recommended.

 

11. Customer responsibilities

Customers agree that all information supplied before and during a saddle fitting is complete and accurate to the best of their knowledge.

Customers remain responsible for informing WTT of any relevant changes affecting the horse before the appointment.

This includes changes to:

  • health

  • behaviour

  • workload

  • fitness

  • weight

  • injuries

  • veterinary treatment.

 

Failure to provide accurate information may affect WTT's recommendations.

 

12. Purchasing a saddle

Where a customer decides to purchase a saddle during a fitting appointment, payment in full is required immediately unless otherwise agreed in writing. Ownership of the saddle transfers once full payment has been received. Risk in the saddle also transfers to the customer once they take possession of it. The saddle becomes the customer's responsibility from that point onwards.

 

13. Seven-Day Cooling-off Period

Western Tack Trader offers customers a Seven-Day Cooling-off Period. This period allows customers to ride in and assess a purchased saddle before making their final decision. This period is offered in addition to any statutory rights that may apply and does not replace those rights.

Customers wishing to return a saddle must notify Western Tack Trader within seven calendar days of purchase. Once notification has been given, the saddle must be dispatched within three calendar days, and details of the shipment (such as a tracking number) sent to WTT.

The customer remains responsible for the saddle until it has been safely received by Western Tack Trader.

The saddle may be ridden during the approval period, including at competitions. However, customers must take reasonable care of the saddle throughout this period. The saddle must not:

  • be modified in any way;

  • have any parts removed or replaced;

  • have conchos, strings or fittings removed;

  • have stirrups, fenders or other components exchanged;

  • be cleaned, conditioned or oiled with any products (light cleaning to remove dust etc is acceptable);

  • have serial numbers removed or altered.

 

The saddle should only be used in reasonably clean riding conditions ans stored safely in a place where it cannot get damaged or dirty. It must not be returned excessively dirty, muddy, sweat-soaked or otherwise showing avoidable wear. If the saddle is returned damaged or in a different condition from when supplied (allowing only for reasonable inspection and permitted riding during the approval period), Western Tack Trader reserves the right to:

  • refuse the return;

  • deduct the reasonable cost of repair or cleaning from any refund; or

  • reduce the refund to reflect any loss in value.

14. Returns and refunds

Customers wishing to return a saddle under the Seven-Day Cooling-off Period must notify Western Tack Trader within seven (7) calendar days of taking possession of the saddle.

Following notification, the saddle must be dispatched within three (3) calendar days using a tracked and appropriately insured delivery service. The customer is responsible for ensuring the saddle is packaged securely to prevent damage during transit.

The saddle remains the customer's responsibility until it has been received and inspected by Western Tack Trader.

Once the returned saddle has been inspected, a full refund of the purchase price will normally be issued within seven (7) business days, provided that:

  • the saddle has been returned within the required timescales;

  • it is in the same condition in which it was supplied, allowing only for the reasonable riding and assessment permitted under the Seven-Day Cooling-off Period;

  • all original components, accessories, packaging and documentation are returned;

  • there is no damage, excessive wear or unauthorised modification.

 

The customer is responsible for all return postage and insurance costs. If a returned saddle requires cleaning, repair or replacement of damaged parts, Western Tack Trader reserves the right to deduct the reasonable cost of those works from any refund. Nothing in this policy affects your statutory rights under applicable consumer legislation.

 

15. Custom and special-order saddles

Western Tack Trader supplies both in-stock saddles and saddles that are specially ordered for individual customers. Custom-made saddles and special-order saddles may be manufactured or sourced specifically to the customer's requirements and may take approximately two to four months to arrive, although delivery times are estimates only.

A deposit of between fifty percent (50%) and one hundred percent (100%) of the purchase price is required before any custom or special-order saddle is ordered. The required deposit amount will be confirmed before the order is placed. Once an order has been submitted to the manufacturer or supplier, deposits are non-refundable.

 

Custom-made and special-order saddles cannot be returned simply because the customer changes their mind. Where a manufacturer is unable to supply a saddle for reasons outside Western Tack Trader's control, WTT will discuss the available options with the customer.

 

16. Delivery

Where a saddle is purchased during a saddle fitting appointment, it will normally be left with the customer immediately. For remote purchases, saddles and other products will be dispatched using a reputable tracked courier service.

 

Delivery times provided are estimates only and cannot be guaranteed. Western Tack Trader is not responsible for delays caused by courier companies, customs authorities, adverse weather conditions or other circumstances beyond our reasonable control.

Customers are responsible for ensuring that the delivery address provided is accurate. Any additional costs arising from an incorrect delivery address may be charged to the customer.

 

17. Used saddles

Used saddles are carefully inspected before being offered for sale. Any significant defects or signs of wear known to Western Tack Trader will be disclosed before purchase. Because used saddles have been previously owned, customers should expect reasonable signs of use consistent with their age and history. Photographs form part of the product description wherever practical.

 

18. Manufacturer warranties

New saddles are supplied with the manufacturer's warranty where applicable. The scope and duration of any warranty are determined solely by the manufacturer. Western Tack Trader does not provide an additional warranty beyond any rights available under UK consumer law.

If a customer experiences a manufacturing fault, WTT will assist in communicating with the manufacturer and will make every reasonable effort to help resolve the issue promptly.

 

19. Photographs and testimonials

During saddle fitting appointments, WTT may take photographs of the horse, saddle and, where agreed, the rider. These photographs may be used for:

  • fitting records;

  • future saddle fitting advice;

  • customer service purposes.

 

Where photographs or testimonials are intended for use on the website, social media or other marketing materials, Western Tack Trader will always obtain the customer's permission before publication. Customers remain free to decline without affecting the service they receive.

 

20. Intellectual property

All content published on the Western Tack Trader website, including but not limited to:

  • text;

  • photographs;

  • graphics;

  • logos;

  • branding;

  • documents;

  • guides;

  • downloadable resources;

  • website design;

is the intellectual property of Western Tack Trader or is used with permission. No material may be copied, reproduced, distributed, modified or republished without prior written permission.

 

21. Website information and disclaimer

The information provided on this website is intended for general educational and informational purposes only. Whilst every reasonable effort is made to ensure that information is accurate at the time of publication, Western Tack Trader makes no guarantee that all information will remain complete, accurate or up to date.

Advice published on this website, through social media, emails or other marketing materials should not be considered a substitute for an individual saddle fitting consultation. Every horse is different, and saddle suitability depends upon the individual horse, rider and intended use.

Information published by Western Tack Trader should not be relied upon as veterinary advice, diagnosis or treatment. Where a horse is showing signs of pain, lameness, behavioural changes or any other health concern, customers should seek advice from an appropriately qualified veterinary surgeon before making decisions regarding saddle fit or continuing ridden work.

Customers remain responsible for ensuring that any saddle they use remains suitable for their horse over time.

 

22. Limitation of liability

Nothing within these Terms and Conditions limits or excludes liability where such limitation would be unlawful. Subject to applicable law, Western Tack Trader shall not be liable for:

  • changes in saddle fit resulting from normal changes in the horse's shape, condition or workload;

  • inaccurate recommendations arising from incomplete or incorrect information supplied by the customer;

  • injuries resulting from horse behaviour;

  • injuries sustained whilst riding during a saddle fitting;

  • damage caused by unsuitable handling of the horse;

  • loss resulting from misuse, alteration or poor maintenance of products;

  • indirect or consequential losses arising from the use of products or services.

 

Customers remain responsible for ensuring that all riding activities are carried out safely and appropriately.

 

23. Force majeure

Western Tack Trader shall not be liable for failure or delay in performing any obligation where that failure results from events beyond reasonable control. These include, but are not limited to:

  • severe weather;

  • flooding;

  • fire;

  • illness;

  • road closures;

  • vehicle breakdown;

  • industrial action;

  • pandemics;

  • supplier delays;

  • import restrictions;

  • acts of government.

 

Where reasonably possible, customers will be informed promptly and alternative arrangements discussed.

 

24. Privacy

The collection and use of personal information is governed by our Privacy Policy and Cookie Policy, which form part of these Terms and Conditions. By using our services, customers acknowledge that they have had the opportunity to read these policies.

 

25. Changes to these Terms and Conditions

Western Tack Trader reserves the right to amend these Terms and Conditions from time to time. The latest version will always be published on our website. The Terms and Conditions in force at the time a booking is made or a purchase is completed will apply to that transaction.

 

26. Governing law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
